First, the veteran must receive 100 percent disability compensation from the VA due to the veteran's service connected disability. Second, the veteran must have a rating of 100 percent disabled or of individual unemployability from the VA or the veteran's service branch. If you are a disabled veteran who meets these qualifications, you must apply for the exemption using the form provided by the State Comptroller's office. The exemption is effective for the current 2009 tax year. Planning for the approval of the constitutional amendment, legislators approved House Bill (HB) 5. HB 5 provided tax relief to senior citizens and disabled persons by ensuring school tax ceilings were reduced proportionally to reflect school tax rate reductions granted to all other property owners. During September 2007, the school tax ceiling amounts were recomputed and used in the 2007 property tax billing. Elderly and disabled taxpayers can expect the same school tax ceiling amount to be used in the 2008 property tax billing unless they have made improvements in their home (other than normal repairs/maintenance) or they have moved to a new home.
